bad noise and air pollution on 5th ave

I live above where Puppets Jazz Bar and Something Else (the record store) used to be. The current lease holders are building what I'm told is to be an Indian restaurant, which makes me excited. (Although I miss Something Else a lot.) However, the workers are running a generator all day long! This generator sits outside of the construction site and stinks and makes a huge amount of noise. I understand that these guys are trying to get a job done, but I'm wondering if it violates some kind of pollution law. Anyone know?
