If watch 7-10 mins through, you'll get the point that detention without arrest is sort of a new tactic being employed here -- the pd doesn't have to swear an affidavit, but the detained person is held against their will and unable to do their work documenting the protests outside the RNC.

Unconstitutional, yes.

    Maybe the water bottle was filled with holy water from the local font and they are angry that he was planning on dousing them to cleanse their sinful democratic ways. Maybe it came to fisticuffs when he screamed "And I'm not going to recycle this bottle when I'm done with you!!"
