Building Height of New Construction

Does anyone know the legal building height for new construction? There is a vacant lot on 22nd Street between 6th and 7th that has a stop work order on it. The DOB website states that it originally was approved for 50 feet. I thought the new rule was 40. Any insight would be appreciated!

    its all about what the area is zoned for.
    ..sometimes you can also get exemptions, etc depending on air rights, setbacks from the street, etc.

    you can try propertyshark.com or the DOB site
    type in the address, see what it is zoned, then research the permit

    If you look at the diagram, you'll see that the maximum height is 40-feet for the "base" but another 10 feet is allowed above that if anything about 40-feet is set back at least 10 feet.... so the effective maximum height is 50ft.

    It's R6B, 40' at the street wall , with a max height of 50' after a 15' set back. Approx 60% lot coverage.

    The owner is bankrupt (the other partner "was" our lovely developer of the 11 homes on 23rd/7th Aves) and the site has been abandoned.

    I would not worry about anything being built here for a long time, which is unfortunate, since the vacant lot will (has) become an eyesore. Wait till the summer and mosquito season starts.

    Bank owns it...and the owner fled to France

    Looks like they will be building on that lot. Corcoran had OH today at the model around the corner. Building five more townhouses.
