brower Park after hours

Was just given a pink summons for disobeying park sign for being in Brower Park @ 6:52. Some park signs say park closes at dusk but at least two others say park closes @ 9:00 pm. I know officers were looking for outstanding warrants but still issued a summons, anyone have any expeirence with this kind of stuff?

No, but I wish they'd issue these summons/citations for Elijah Stroud Park. Sounds like law enforcement is doing their bit to help the city's budget issues.

Take a picture of the signs that says park closes at 9:00 pm and show up at court with the evidence. A judge may just let you off on the technicality if the signs contradict the cops and each other. Of course, you'll be asked what you were doing in the park after dark, so you better be prepared to explain that.

I have taken that exact picture and I was walking my dogs, as I waited for 1 of the officers to write the summons at least 14 other people walked by and the other cop only grabbed one other person, it was very strange almost as if he was looking for something specific?????? Other then people in park after dark specific?????

He probably was (looking for something specific), but the cops will rarely tell you when they are.

Call Community Board 8 (CB8) 718-467-5574. Your local community board sets the access time of public parks (parks under the control of NYC Dept. of Parks). After you get your ticket adjudicated, try coming out to the 77th Pct. Community Council meeting on the 2nd Monday of December. The location floats, so call the pct. at 718-735-0611 to find out where the December meeting will be held, or ask CB8 if they have been notified. There you can complain about the apparent inconsistent policing that you experienced.

(fyi) Sunrise today, 11/21/2010 was at 6:50am and sundown is at 4:34pm as per the NY Times.

Why should someone have to justify his or her presence in a park at 6:52 pm? If a sign says park is open till 9 pm - that isn't a technicality - that is being not guilty!

I'm not sure if the sign says the park closes at 9pm or dusk, but with recent shootings in and around Brower Park, the Police are left with little options. It's unfortunate that good people have to suffer because of the actions of a few idiots.

That is sometimes the problem. "Discretion" means different things to different people.

Some cops look at people of color and do not see "good people." Others look at hipsters and go into a blind rage.

Remember the cop who was filmed launching himself at a bicyclist, knocked him off his bike, and then claimed to have been assaulted by the bicyclist? To the cop, the bicyclist was not "good people."

There are signs saying dusk and 9pm, right now there are at least 7 people in park I can see, and there is a cop car standing at park and brooklyn. Yesterday there were 2 cops walking through brower saying nothing to the people in the park around 730 pm. Seems like I just had bad timing.

Enforcement in Brower Park is a day by day thing. The park opens at dawn and closes at dusk. If there is a sign saying 9PM, the judge will tell you it is moot and use the time that will bring revenue.

Suggestions to complain? Complain about what? If there were a bunch of other people breaking the law and you got caught, it just wasn't your lucky day, pilgrim.

Sad thing is, whilst your in your comfy pad, sipping on whatever, worrying about reality fiction on tv, not paying attention to your gubbermint, lawmakers have made damn near everything illegal. Laws sit in the books, laying in wait, available for indiscriminate enforcement at any time. And you got pinched.

The next trick ? is are you gonna pay up, no ? asked, or ? the summons. It becomes a question of economics now. Is it worth you taking time and potential income out of your life to fight a summons. Does the math make sense? The city is counting on no. They're banking that you and half the other 5-10,000 people that got a ticket that day just drop a check in the mail.
