Instagram said today that it has the perpetual right to sell users' photographs without payment or notification, a dramatic policy shift that quickly sparked a public outcry.

The new intellectual property policy, which takes effect on January 16, comes three months after Facebook completed its acquisition of the popular photo-sharing site. Unless Instagram users delete their accounts before the January deadline, they cannot opt out.

It's already been reported that they're changing their TOS to make clear that they're not going to be selling any photos without the permission of the owner and that the owner will be compensated.

Made-up but startlingly accurate statistic: 99.99% of users who are whining about Instagram's new TOS would never have any of their shi**y, overfiltered photos ever used in an ad by Instagram or anyone else.
