yours is about trying to engineer people from doing something stupid. This post is full of posts on and about adults. The stupid kids that tossed the cart over did so because they had time and a cart. A high rail may have made it less likely but their moms begging for forgiveness should have had them out of jail. Stupid fuc_in kids sure but jail time, no. No Nanny State

If they avoid jail they'll just be that much more certain that there are no adverse consequences to misbehavior.

They should absolutely spend a week or so in jail, just to put the fear of God in them.

At the kids' arraignment, the judge got to quickly consider the evidence in the case, and whether there was sufficient reason to believe the kids did the crime. Then, the judge got to decide whether the incident was an aberration or part of a pattern of delinquency, and see if this kids have any effective adult parent figures.

Then, the judge made a choice between following choices:

    secure detention until trial: http://www.nyc.gov/html/acs/html/yfj/youth_family_justice.shtml

non secure detention until trial: http://www.nyc.gov/html/cjc/html/youth/risk.shtml

    .

    .

    .

Assuming the kids are found guilty at trial, the judge will consider the seriousness of the findings and have additional choices to choose from, like these:

A program that allows the kids to remain at home, with services: http://www.childrensvillage.org/community-mst.htm

A program that involves the kids living at a non-secure setting run by a non-profit: http://www.lincolnhall.org/

A program that involves the kids living in a state run, secure facility: http://www.ocfs.state.ny.us/main/rehab/DJJOY Facilities MAP.pdf
