Noise Violations?
It's the second time this week that we've been woken up in the middle of the night by a private garbage truck coming to pick up debris left from the Meier construction site. The truck comes at 4am and makes so much noise that I'm awoken through my ear plugs!!!
Is this against the law? What should I do? Who do I call to complain?
Between this and the Tony Bennet motorcycle guy, I'm starting to lose it!

Call 311 and ask to speak with the Department of Environmental Protection. They handle noise complaints.

City law generally allows construction only on weekdays between 7 a.m. and 6 p.m. On weekends, work is also allowed on one or two-family homes between 10 a.m. and 4 p.m. Use or transportation of construction devices or materials that cause unreasonable noise is always prohibited.
Yah, 311. A private garbage truck at a construction site is considered transportaion of construction materials, I believe, so it may be DOB instead of DEP, FWIW. Point being, don't ask for DEP, necessarily. I think the DOB would have bigger teeth in this case anyhow. -
Yeah, asking for both on separate calls is probably even better.
DEP are the ones who come out with noise meters if you're lucky. But I bet DOB would be the ones enforcing the truck schedule.
But unless 311 has gotten much much better in recent years, it helps to ask for something specific. Or else they'll send you in circles! -

Thanks! I actually called 311 this morning around 7am. but they asked if the noise was still happening and it wasn't so they couldn't really do anything about it. I'm okay with noise at 7am on a workday. It's the 4am that's ridiculous.

i wasn't able to find it on first glance, but there was a recent ny times article about private garbage trucks making people want to move to get peace and quiet.

yes, construction on that bldg has been the bane of my existence the past 2 1/2 years. they seem to only operate the jackhammers b/t 7 - 9 am (and then, perversely, stop), violate the no work on weekend rule, sometimes start work before 7 am, and have their dumpster emptied noisily at 4 am. i wouldn't be shocked if they were behind the antony benidito on a motorcycle guy either. i've called 311 many times but it doesn't seem to have any impact.

that's what I figured too...when I called 311 they said I need to call when it's happening. I can't think of anything more frustrating than calling 311 at 4am in the morning just to be told there's nothing they can do.
