Lease Renewal

I live in a non-regulated apartment. My lease is due to expire on July 30th. Does my landlord have to give me a new lease if I ask for it a certain amount of time before 7/30? Or could he pop it on me 7/21 and say take it or get out by 7/30?

  • I called my land lord 6 weeks before our lease ended to ask for a new lease and discuss price. He got it to me the next week.

  • I'm not sure how much time he needs to give you, but the law heavily favors tenants and it is very hard to get a tenant out. There is no way he could do it in 9 days, even if he was a total asshole and came at you with everything he could.

    Do you have reason to think he's going to try to throw you out or why he would wait until the last minute to give you a new lease?

    Go to tenant.net and somebody can tell you more about the legalities. Those people know *everything* about leases.
  • In an unregulated apartment there is (1) no long-term lease requirements, and (2) no expectations for continued tenancy after the expiration of the contract. You can go month-to-month after the lease or the landlord can offer you a new contract....

    Long story short, you should talk to you landlord. The landlord may simply think you are (1) moving out at the end of July or (2) intend on going month-to-month. If it's the latter -- the only requirement is 30 days notice of the termination.

    There's nothing "legal" that he has to do at this point.

    If you get calls in the next week or so to show the apartment, it's probably a good sign they don't expect you to stay! :?
  • Actually -- have you read your lease? It probably spells out what happens at the end.... my last 1-year lease (i've been month-to-month for two years) had a paragraph about after the lease expired.

  • Some leases in non regulated apartments have an automatic renewal (illegal under stabilization) unless you inform the LL otherwise. Have you checked? There's no reason why you couldn't initiate negotiations. It is worth more to him to have a good tenant in place then going through re renting presuming you're already paying market rent.
  • Have you had any problems with the landlord before? If you pay your rent on time, don't be a pain to deal with, etc. its probably either the landlord forgot to do it, or that rents are down and they don't want to bring it up because they are afraid you will ask for a rent reduction, and are happer to just go month to month...

    It isn't likely they could just boot you out (I'd imagine there are requirements about giving notice to vacate, etc) so you would have some time no matter what...I can't see how they could get marshalls, etc to just show up without first asking you to eave...But my guess is that when the clock runs out on your lease, nothing happens...Just keep paying rent as before and you'll go to month to month (ie 30 days notice by either side to terminate the agreement)

    But I'm not a lawyer...Bring it up with the landlord if you are concerned...
  • My lease states that unless there is a new 1 year lease signed, I go month to month automatically. This has been my experience in my previous landlord too.
  • Someone in the building, they got their renewal 5 days before the end of the lease asking to renew at $200 more a month and needed to notify landlord in 2 days. They sent a request for a renewal more than 45 days prior to that and followed up again a couple weeks later and never heard back until that last week. Seems they're trying to bump people out or something, who knows.
