"After shelling out a reported $90 million to buy PlanetAll in 1998, Amazon shuttered the site in 2000, explaining that 'it seemed really superfluous to have it running beside Friends and Favorites.' But years later in a 2008 patent filing, Amazon described the acquired PlanetAll technology to the USPTO in very Facebook-like terms.
And on Tuesday, the USPTO issued U.S. Patent No. 7,739,139 to Amazon for its invention, the Social Networking System, which Amazon describes thusly: 'A networked computer system provides various services for assisting users in locating, and establishing contact relationships with, other users.
For example, in one embodiment, users can identify other users based on their affiliations with particular schools or other organizations. The system also provides a mechanism for a user to selectively establish contact relationships or connections with other users, and to grant permissions for such other users to view personal information of the user.
The system may also include features for enabling users to identify contacts of their respective contacts. In addition, the system may automatically notify users of personal information updates made by their respective contacts.' So, should Facebook CEO Mark Zuckerberg worry about Amazon opening a can of patent whup-ass?"

aka
"the full employment act for lawyers who wish to argue that somehow their client's software is distinct from that covered by the Amazon patent" -
I'm not a patent lawyer, but the quoted description sounds like a "business method" patent, which does not depend on the particular software or technology used to achieve the desired result.
In other words, even if Facebook's software is entirely different from PlanetAll's, if the results are similar, Facebook could have a serious problem. -
^^^ so noted.
how about:
"the full employment act for lawyers who wish to argue that somehow their software's results are completely distinct from that covered by the Amazon patent"
?
P.S. If booklaw was a patent lawyer, would I already owe him money? -
the whole modern copy rights/patents are all bs. I love pirates !!! true innovation.
-
Armchair, most pirates don't innovate... they just steal and distribute.
US copyright law accommodates our First Amendment rights of expression by explicitly permitting "fair use", i.e. the use without permission of small percentages of someone else's copyrighted work for purposes of commentary, criticism, scholarship, parody, etc.
One of the ways I make my living is by helping documentary filmmakers determine how much of other people's copyrighted work they can incorporate into their films without permission or payment to the copyright owners. They are reusing and repurposing the previously published material, but if it's "fair use", it's not piracy.
US trademark law also includes accommodation for First Amendment rights. -
Whynot, my bill is in the mail...
