Former Brooklynian spammer arrested for sidewalk chalking
Longtime Brooklynian readers may remember that we had some major annoyances a couple of years ago with this guy repeatedly spamming the site. As stupid as these graffiti arrests for sidewalk chalking may be, I can't help but feel a little schadenfreude about this. :twisted:

Apprehended! Second chalker nabbed by cops

The city’s crackdown on sidewalk chalk “vandals” is officially out of control! It was bad enough when the Sanitation Department threatened the parents of a 6-year-old Park Slope girl with a $300 fine if they did not remove the offensive “graffiti” — her sidewalk chalk drawings on their own front stoop.
But after we ran our front-page story about Natalie Shea and her chalk “vandalism,” a Cobble Hill chalk artist who had never been arrested before suddenly found himself in handcuffs and spending a night in the lockup.
Coincidence? Not likely, considering that the artist, Ellis Gallagher, had been quoted in the original Brooklyn Paper piece — a story that the desk sergeant just happened to be reading when Gallagher was brought in.
“The cops had spent about half an hour debating whether to arrest me, so they finally called the sergeant who said, ‘Bring him in,’” recalled Gallagher. “And when I get to the 76th Precinct [stationhouse], sure enough, the sergeant is reading The Brooklyn Paper and laughing at me.”
While we’re not surprised that the sergeant was reading Brooklyn’s real newspaper, Gallagher was stunned to be arrested and held overnight because of a few benign comments in our Oct. 13 issue:
“Cops stop me all the time when they see me drawing on the sidewalk,” Gallagher had said at the time. “But once they see it’s just chalk, they always let me go.”
Not anymore.
On Oct. 17, Gallagher was at the corner of Smith and Warren streets, creating one of his trademark shadow drawings — in chalk! — for the PBS show “New York Voices.” He says that two cops in a patrol car stopped and asked if he had permits to do his work, but, like so many times before, Gallagher showed off his chalk and expected the cops to be on their way.
But not in the current climate — not when chalk-bearing 6-year-olds are running wild!
The cops referred to their penal law codes and then flagged down two more officers, who joined the sidewalk debate over whether to arrest Gallagher, whose work consists solely of outlining the shadows of objects in chalk.
Gallagher was ultimately charged with making graffiti, possession of graffiti-making materials and criminal mischief.
After spending the night on a hard bench, Gallagher’s case was dismissed at the Red Hook Community Court.
Now, this is the part of a normal column where the writer would call some free speech lawyer for the suitably appropriate condemnation of the arrest. But you don’t need to be a lawyer to feel that somewhere between Natalie Shea’s innocent, child-like drawings and the arrest of Ellis Gallagher, something has gone off the rails in this city.
Even the NYPD told me two weeks ago that what Shea and Gallagher are doing is not graffiti because chalk doesn’t even last through a minor rainfall. But that didn’t prevent the city from sending Natalie’s parents their warning letter. And it didn’t keep Gallagher out of jail.
His mission now is to get the law changed so that chalk is explicitly exempted from the current city graffiti law, which is vague on whether scrawls made from impermanent materials can be considered graffiti.
He’s looking for a good lawyer or a Councilmember willing to stand up for art, children’s sidewalk scrawls and future generations of hopscotch players everywhere.
Sounds like child’s play, no?

So basically if I take chalk and write all over your Brownstone, I should't be arrested because chalk is not permanent? I agree the 6 yr old drawing on the sidewalk to play hopscotch, shouldn't be hassled. But a grown adult decorating the sidewalk? Lock his ass up!! I suppose swastikas in chalk are acceptable too?

CHALK?!?!?!? yeah, maybe the cops could spent less time bothering people for drawing in chalk and more time keeping people from getting shot on my block.

No, he posted under a variety of names based on his own: Ellis Gee, Ellis G., Gee Ellis, etc. He'd have whole conversations between his various sockpuppets in a single thread -- all pimping his art or sometimes businesses he was associated with. Thing is, the first few times people posted about his sidewalk chalking, if I remember right, it was all expressions of admiration for his work, and he very quickly blew all of that goodwill by coming here and acting like a jerk. -
Sounds like the arrest was bullshit, but I can't say I'm sorry it happened. That Ellis G was an ass.

What I said was that there is no summons for Graffiti, Im sure the Dept of Sanitation summons was probably something to the effect of Having a Dirty Sidewalk. Also there is a big difference between a 6 yr old and an Adult in the eyes of the Law. BTW it is not the Cops pushing for the arrests of Graffiti Vandals its the Mayor. Refer to exhibit A:

as much as I hate the sidewalk chalk arrests, I agree - ellis g. was such a pain in the ass that, as a moderator of this site, I relish his stupid ass getting locked up. I realize this thinking is wrong. I understand that I am coming off as a caustic bitch. but damn, I love it when the cops can make someone I dislike miserable. yay!

There is also a big difference between sidewalk chalk and spray paint. I'm don't think invoking the mayor's Paint Program over sidewalk chalk is valid. Anyone calling to get sidewalk chalk painted over is being a bit silly, in my opinion. I'm OK with debating sidewalk chalk as graffiti, but not in invoking a graffiti paint over program as evidence that the mayor is who is pushing sidewalk chalk arrests.

Maybe you're not aware, but theres a little thing called Graffiti Stat held every other month at 1 Police Plaza, where Precinct Commanders are berated, while a display of the handy work of these talented vandals is displayed on plasmas TV's that surround the room. -

That talks about "the transit system is still at the heart of the graffiti culture." I have yet to see any subways or buses hit by sidewalk chalk. It also talis directly about "tagging", which is also not sidewalk chalk specific. I didn't see anything in there supporting your position above that the mayor is behind the crackdown on sidewalk chalk, neither for adults nor children. I think you are stretching a bit here. I think that it is clear that this was entirely up to the discretion of the officers involved. The judge obviously didn't agree with them, since the ticket was dismissed. We can argue whether sidewalk chalk warrants arrest under graffiti rules, but to say that this is being pushed by the mayor is not really accurate.

Agreed! It's time someone stood up against defacing public property. Luckily, the Bloomberg administration has been standing up against quality of life crimes. A police officer said Mr. Jones was impeding other pedestrians and charged him with disorderly conduct.
Mr. Jones is not taking the charges lying down (so to speak). After trying twice to get the charges dismissed, he has taken his case to the state's highest court, the Court of Appeals, which heard arguments here on Wednesday.
In the prosecution's view, it appears, the innocent do not dawdle. According to the original complaint against Mr. Jones, the officer ''observed defendant along with a number of other individuals standing around'' on a public sidewalk in June 2004. Mr. Jones was ''not moving, and that as a result of defendants' behavior, numerous pedestrians in the area had to walk around defendants.'' -

Subject: Maybe its not the chalk but the art that was offensive?
So that's what happened to the "shadow chalk graffiti artist". I'm a creative person but I just didn't "get it".
After viewing these studies of futility I always wondered if the person just had too much time on their hands. I mean it seemed kind of OCD. Then when the drawings stopped I was wondering if the person finally developed a lower back problem and their chiropractor talked some sense into their head.
While I never wish a night in jail on any person, the Brooklyn PD probably was annoyed too and decided to take action.
Maybe the universe is trying to tell this "artist" to express their creativity in another format.
Thanks for providing the answer to this question that has been on my mind.
