    My girlfriend got fired in July after less than three months of work because she has retardation. She has been collecting unemployment to the tune of over $1600 a month since then.

    Makes me want to go to Subway Inn right now and do shots while she lounges on her couch and watches every movie ever made.

    I don't think it's contagious, (man that looks weird, must be spelled wrong) but you don't want it. She is fired from every job she has ever had and it's really demoralizing. Imagine being out of work for six months and having to look for another stupid job you don't want in this economy. Well, if you do get yourself fired just make sure Mougar supplies the dumplings! That will keep you busy while I entertain Papi Chulo. Hee hee

    I'm pretty sure the only reason you can get denied if you're fired/laid off is if you are fired for "gross negligence" or something else where it's demonstrably your fault. So if you're like a graphic designer and they fire you because they "don't like your designs" I'm pretty sure they'd have to go a long way to prove it was your fault.

    The law says that you cannot collect unemployment legally if you left your job under your "own will". Your "own will" includes being "terminated for cause".

    Overall, the process goes like this:
    1. Employee leaves job.
    2. Now former employee files for unemployment.
    3. The state sends notice to the former employer that the person filled for unemployment.
    4. The employer now can choose whether to "protest" the claim. In order to protest, the employer has to prove through documentation that the employee either quit his job or was "terminated for cause". If the employer argues the latter, the employer must prove through documentation that the former employee willfully broke the company's policy. More specifically, the employer has to send in any warning letters, lateness logs, drug test results, and other document deemed relevant to the termination.
    5. The state representative determines whether the employer had "just cause" to terminate the employee. If it is ruled that the employer could not prove that there was this "just cause" the employee will receive unemployment.
    6. If either the former employee or the employer does not feel the ruling is just, he/she has the option of arguing his/her case in front of a Judge.
    7. The Judge then makes the final determination.

    The reason why some of you were able to receive unemployment after you were fired is probably because your former employer either did not have the proper documentation of your insubordination or because they did not want to spend hours on the phone with a state representative.
