    this is crazy. is anyone trying to get out of the lease and move in to another building? if they treat their residents like this now, how will they treat them when they finally move in? When something needs to be fixed in the apartment? If they can't provide an actual move in date, they must release you from the lease? Has anyone contacted the news? I bet 1 piece on the evening news will get this moving along quite nicely.

    We haven't signed anything confirming October 1. If I can cancel the check I will if not, I guess my lease will start Nov 1

    My worry in potentially subletting is that the construction rider says the landlord will set the move-in date. Given BKLYN Gold's attitude so far, I wouldn't be surprised at all if they say "Your lease is starting on day X, tough luck if you subletted a place already." That was my interpretation of their decision to "offer" some people the "opportunity" to move back the start date to Oct. 1.

    I talked to Markowitz's office again today. They said that Brooklyn Gold still needs signoffs for elevators, construction, and plumbing. But the Building Information System shows signoffs for all three, from 8/09 and 9/01. So I don't know what to believe now.

    Last time I told them I needed to change my lease date it was ok. Granted they didn't have the TCO yet. I guess I'm taking a chance and will have to hope it all works out and we don't end up paying rent for no reason.

    The DOB told me that with the amount of their outstanding items, it may be a month or more before it's signed off on. I'd rather be safe than homeless.

    But they choose when we occupy. It's illegal to charge rent for a building that doesn't have a TCO.

    Actually, the letter that was updated today--ENVIRONMENTAL "E" DEP NOTICE OF SATIS--was updated for 277 Gold Street on 1/25/2010--the day it received its TCO.

    It looks like they had a full folder review with T Fariello on that day and the DEP NOTICE just so happened to be signed off during that review. There were some other things that also got approved for 277 Gold that day, that still have yet to be signed off for "235" (257). So I don't think we can count on a TCO just yet just because that was signed off.

    As per the B-scan list of required items, there are a few things that make me nervous ( whether the list has been accurately updated is another story).
    Though they do have temp apps for plumbing and electrical, they do not seem to be signed off yet. They obv don't need finals approvals for those, but temps are necessary for a TCO. I also see nothing about a boiler sign off, which was approved prior to 277 receiving their TCO.

    Also, it looks like 277 won't be getting its TCO renewed so easily this time as John Gallagher is tightening up ship and asking for a full review prior to any renewals. Maybe he is on to the developers / architects / contractors shady practices, and is going to scrutinize more carefully.

    Again, all speculation, but I am "supposed" to move in Oct 2nd, but I am not making an arrangements to move in until I have keys in my hand. Ill keep my fingers crossed, and I don't want to sound like a Negative Nancy, but I'm not counting on starting my lease this weekend. :(

    True, but I thought it was a good sign given that the leasing office had told people they expected positive news today.

    There is a partial plumbing signoff, for all the residential floors (TEMP PL FOR FLOORS 4 THRU 13 ONLYNSGN09/01/201009/01/2010) . But, yeah, I don't see anything about an electrical signoff.

    Yes I tried. I asked and had a real estate lawyer review. The only was to bream the least is to give them the deposit and first month or if this continues and you are not able to move in for 90 days. Only other option is if we can prove this is the owners fault.

    Hi guys, I was supposed to move in today according to so called lease Agreement Heard from Michealea about pushing back my move in date last Tuesday. And now I am packing my stuff and reserve uhaul&storage. Going to sleep over my friends sofa for next? Maybe months? I am so tired and whatever. :(

    Subject: Really, Brooklyn Gold?

    Long time reader, first time poster.

    I vote that we have a party on the roofdeck when this is all done with. And if they are so inclined to have the roof deck closed, I am sure at least one of us will have the skills to make it accessible.

    Thank you to all the people that are making an effort to find out information for the rest of us, and for being proactive in calling officials. :)

    PS- I was supposed to move in Sept 1, from out of state, and I have been sleeping on rotating friends' couches since then. I'm planning on subletting month by month until we can move in- an idea for the others that are homeless as well. (Craigslist has tons of month by month rentals.)

    Move every month is not a option for me who WMAO. Last few days, I barely be able to concentrate on my job. Oh no, jobless after homeless?!


    Btw, here is what I got from Brooklyn gold, last tuesday: Papers were all filed - no appointment, just approvals. This could be received soon.

    i've gotten this today:

    I don’t have a response from the owner yet about the DOB. I’m still waiting until 6pm and then will give you the next update unless I get it prior to end of the day. So sorry – I wish I could say all is good, but I am told the approval is imminent and that’s all at this point.

    My moving day is Thursday so I have movers all lined up to come to my curent home and move me to either (1)BKGold (delusional, I know) or (2)storage. I will then start commuting form my PA home (2hrs each way) while in LIMBO hell.

    I feel your pain, I commute 2 hours+ each way from Eastern Long Island to Brooklyn everyday. BK Gold is only .9 miles from my work, the commute is killing me.

    The woman at this DOB number--(718) 802-3677--(Brooklyn borough commissioner's office) seemed to know much more about 235 Gold Street than the people at the other DOB numbers I've called. But she was also far less helpful, to the point that she was very rude, because I was calling as a tenant.

    Off the top of her head, she said that a TCO application had been denied for 235 Gold Street, but she couldn't tell me when. She sort of looked it up, but then kept saying "I'm not even supposed to be talking to you." And then she never gave me the date. I'm guessing it was in early Sept., when CoEd failed to install the gasline.

    Maybe someone else will have a better shot?

    WTF, this is crazy-- it is all top secret. Maybe because the law is on our side if the owner screwed up...ie, if they filed too late. Then we have the right to get our money back. Anyone heard from Tonya Hill? I haven't heard back from her and left my message last week.

    I've been reading this thread for some time (basically since I signed the lease). I was aware of the situation with the building and despite that decided to take a gamble and sign for an Oct 10 start date. I'm still hopeful that it'll happen (but that hope diminishes each day). Like others, I'm stuck in a 2+ hour commute until I can move.

    The lack of specific knowledge of the situation is the most frustrating part for me. Even if I had a yes or no for the move in date, I'd at least be able to make plans.

    I wouldn't mind an email chain. If other active posters decide on that, I'll PM my address.
